INDEPENDENCE, MO — The Independence City Council is trying to sort out competing special use permits for similar carwash locations, The Examiner reported.
As it was considering a recently-submitted special use permit, the council learned that a similar one had been granted for a nearby location 18 years ago. As a result, it decided to send the ordinance regarding the new special use permit back to the Planning Commission to sort out the details, the article stated.
Dwight Davis is the owner of the old special use permit issued in 1986. Davis, who has spend the last 30 months trying to meet current regulations, purchased the land and permit from the original owner 30 months ago and, unlike the original owner, he plans to construct his carwash, the paper reported.
"There used to be a fuel station on the land so we had to remediate the soil," Davis said in the article. "The state has spent $223,700 to clean the soil and meet EPA standards. They finished June 22nd, and I am just waiting for the state to review the test results."
Independence Planning Manager Tom Kuntz said in the article that there is nothing stopping the 18-year-old special use permit from being valid. "We went back to check in the books and we found that it doesn't expire," Kuntz told the paper. "New plans would have to be submitted but there's no provision stopping it from happening."
Dalin Antwiler, of Independence, is the owner of the new special use permit recently granted to him and he said that, despite the new information, if the plans are approved he will probably still build his carwash. "The community needs a carwash in that area," Antwiler said in the article. "It's not uncommon for two carwashes to be next to each other."
According to the article, Davis doesn't believe that the area could handle two carwashes. "It's poor for Independence if we both construct one because we won't be able to make it," Davis said in the report.
